Summary
The attorneys of Sherman Atlas have developed a significant practice in entertainment law, representing entertainers, athletes, producers, musicians, actors and other artists in matters involving unpaid royalties and protection of their intellectual property rights. We have also counseled clients in connection with the registration of copyrights, ASCAP and BMI registration, and royalty accountings. Our clientele has included world-renowned artists and photographers, as well as the owner of one of the most significant privately-held Old Masters collections in the world.
We have prosecuted significant matters on behalf of our clients asserting claims based on the right of publicity and the Lanham Act. One case, Prima v. Darden Restaurant, has resulted in a reported Federal Court decision recognizing the right of publicity for the voice of a famous deceased singer/entertainer. We have also prosecuted claims for unpaid royalties and royalty accountings on behalf of entertainer clients.
Our attorneys are familiar with the unique tax and estate planning issues that confront the creators of artistic work, as well as art collectors. We have also worked extensively with our clients on non-profit endeavors to perpetuate their creative work.
Representative clients include the late Gia Prima, the widow of musician and composer Louis Prima; former Olympic boxer Gerald Cooney; former IBF Heavyweight Champion Chris Byrd; Joel Dorn; Guns n’ Roses; the family of the late actress Alice Faye and her husband, entertainer Phil Harris; and the family of actor Sebastian Cabot.
